Terms and conditions
Art. 1 – General provisions
Ownership of the website www.laperacca.com is fromBastianini Francesco Farm, the registered office is located in strada val Chiapini 70 –Casalborgone -10020 TO- VAT number 09118100016, Fiscal Code BSTFNC84S28L219X, Turin Company Register no. TO-1115814 (hereinafter LA PERACCA)
Browsing and submitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site indicated therein.
2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 amended by Legislative Decree No. 21/14 and Legislative Decree 70/03) by La Peracca.
3. The customer is required, before accessing the products supplied by the site, to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
4. The customer is invited to download and print a copy of the purchase form and of these General Conditions of Sale, the terms of which La Peracca reserves the right to modify unilaterally and without notice.

Article 2 - Object
1. These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products onwww.laperacca.com and do not, however, regulate the supply of services or the sale of products by subjects other than the seller who are present on the same site through links, banners or other hypertext links.
2. Before forwarding orders and purchasing products and services from different parties, we suggest checking their conditions of sale.
Art. 3 – Conclusion of the contract
1. To conclude the purchase contract, it will be necessary to fill in the form in electronic format and send it following the relative instructions.
2. It contains the reference to the General Conditions of Sale, the images of each product and the relative price, the means of payment that can be used, the methods of delivery of the products purchased and the relative costs of shipment and delivery, a reference the conditions for exercising the right of withdrawal; methods and times for returning the purchased products.
3. Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.
4. The contract is concluded when the seller receives the form filled in by the user, after verifying the correctness of the data contained therein.
5. The buyer will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will be done by clicking on the "Finish" button at the end of the wizard.
6. Once the contract is concluded, the seller takes charge of the order for its fulfilment. The sales contract between the Customer and La Peracca will only end when La Peracca sends the Customer a separate e-mail containing information relating to the shipment of the product which constitutes acceptance of the Customer's purchase proposal ("Shipping Confirmation") and the possible crediting of the amounts of the unavailable products. The Customer's right of withdrawal is in any case reserved (dedicated section).
Art. 4 – Registered users
1. When completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.
2. Once registered, the user will receive a confirmation email to the email address provided by him. Confirmation must be communicated within 48 hours at the latest. After this period, in the absence of confirmation, La Peracca will be released from any commitment towards the user.
3. The confirmation will in any case exempt La Peracca from any responsibility regarding the data provided by the user. The user undertakes to promptly inform La Peracca of any variation of his data communicated at the time.
4. If the user then communicates inaccurate or incomplete data or even if there is a dispute by the interested parties regarding the payments made, La Peracca will have the right not to activate, or rather suspend the service until the related shortcomings.
5. During the first request for activation of a profile by the user, the same will have to choose the username and password. The latter acknowledges that these identifiers constitute the validation system of the user's access to the Services and the only system suitable for identifying the user that the acts performed through this access will be attributed to him and will have binding effect on him.
6. The user undertakes to maintain the secrecy of his access data and to keep them with due care and diligence and not to transfer them, even temporarily, to third parties.
Art. 5 – Availability of products
1. Product availability refers to actual availability at the time the buyer places the order. However, this availability must be considered purely indicative because, due to the simultaneous presence of several users on the site, the products could be sold to other customers before the order is confirmed.
2. Even after sending the order confirmation e-mail, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically adjusted with the elimination of the unavailable product e the buyer will be immediately informed by e-mail.
3. If the purchaser requests the cancellation of the order, resolving the contract, La Peracca will refund the amount paid within 30 days from the moment in which La Peracca became aware of the purchaser's decision to rescind the contract.
Art. 6 – Products offered

Art. 7 - Invoicing
If the purchase is made by a professional, it will be possible to request an invoice by selecting the appropriate box during the order procedure and entering the billing information including the tax code and/or VAT number. In this case, the invoice will be sent via email to the address indicated. The professional is responsible for entering the billing data correctly and is expressly informed that, if the invoice is not requested during the order phase, it will not be possible to request it later.
Art. 8 – Methods of payment and prices
1. The price of the products will be that indicated from time to time on the site, except where there is an obvious error.
2. In the event of an error, La Peracca will notify the buyer as soon as possible, allowing confirmation of the order for the right amount or cancellation. In any case, there will be no obligation for La Peracca to supply what is sold at the lower price incorrectly indicated.
3. Site prices include VAT.
Prices may vary at any time. The changes do not affect orders for which order confirmation has already been sent.
4. Once the desired products have been selected, they will be added to the cart. It will be sufficient to follow the instructions for the purchase, entering or verifying the information requested in each step of the process. Order details may be changed before payment.
5. Payment can be made via:

6. La Peracca, due to the nature of the internet, cannot guarantee uninterrupted access and the absence of errors in the transmission of the services, furthermore access to the site could be occasionally suspended or limited to allow the execution of the works of repair, maintenance or the introduction of new products or services. If, due to misunderstandings or other inconveniences attributable to the functioning of the computer systems, a price other than the actual one is indicated by mistake ("Ostative error"), La Peracca will contact the buyer to verify whether he still wishes to purchase the product at the correct price. otherwise the order cannot be processed.
Art. 9 – Delivery and shipping conditions
1. La Peracca ships throughout Italy, Europe, Vatican City State and Republic of San Marino.
2. La Peracca will only make deliveries to the user's home, whose data is provided at the time of purchase.
3. The delivery of the products, for which there is availability in the warehouse, as indicated in the relative sheet, is carried out, for the Italian territory, generally within 6 working days, or, if no delivery date is specified, within the term estimated at the time of selecting the delivery method and, in any case, within the maximum term of thirty days from the date of confirmation. If the products are not available, the delivery of the products is made, for the Italian territory, generally within 6 working days from the moment in which they are classified as available in the warehouse.
4. As far as European Union countries are concerned, delivery will be made within 10 days, and in any case, within the maximum period of thirty days.
5. If the buyer fails to collect the goods and, therefore, it is not possible to carry out the delivery, the order will be sent to the warehouse. In this case, the courier in charge of the transport will proceed, at a later time, to make a new delivery. In case of non-collection of the goods by the buyer on the second delivery attempt by the courier, with the consequent return of the goods to the seller, the order will be canceled and will not be refunded.
8. Shipping costs are charged to the buyer for orders under €30.
For orders over €30, shipping is free for the Italian territory.
With regard to shipping costs to European countries, it is specified that:
Shipments for Austria, Germany, Belgium, Luxembourg, France, Holland, Spain, the Balearic Islands, England, Denmark, the Czech Republic and Slovakia they cost €20
Shipments to Estonia, Latvia, Lithuania, Poland, Hungary, Slovenia, Romania, Bulgaria, Croatia, Eire, Sweden and Portugal have a cost of €25.
Shipments to Switzerland cost €55 and those to Corsica €35
Art. 10 – Transfer of risk
1. The risks relating to the products will pass to the purchaser from the moment of delivery. The ownership of the products is considered acquired upon receipt of full payment of all amounts due in relation to the same, including shipping costs, or at the time of delivery, if this occurs at a later time.
Art. 11 – Warranty and commercial compliance
1. In case of lack of conformity of Products sold by La Peracca, the buyer must immediately contact the company by writing to info@laperacca.it.
2. The legal guarantees provided for by articles 129, 130 and 132 of the Consumer Code apply to the sale of the products. The purchaser has the right, at his choice and on condition that the type of product permits it, to restore, without charge, the conformity of the product by means of replacement, or to an adequate price reduction or termination of the contract. The purchaser forfeits these rights if he does not report the lack of conformity to La Peracca within 14 days from the date on which he discovered the defect, provided that it is not a product which by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within this shorter period.
2. All return costs for defective products will be borne by the seller.
Article 12 – Withdrawal
1. The right of withdrawal applies to all products on the Site, upon notification to info@laperacca.it within 14 days of receiving the pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products and subsequent confirmation from us.
2. In line with the Italian law in force, it is possible to exercise the right of withdrawal only for products that can be put back on the market without endangering the health of consumers, as specified by art. 59 of Legislative Decree 206/2005.
Precisely for this reason it is not possible to return food products (including alcoholic beverages) and cosmetics, for which it is not possible to guarantee adequate conservation and which risk deteriorating and expiring rapidly.
Furthermore, it is not possible to return: products made to measure or clearly personalized, orders for which an invoice has been issued, products that have been opened after delivery.
3. In the event of multiple purchases made by the buyer with a single order and delivered separately, the 30-day period starts from the date of receipt of the last product.
4. The goods must be replaced intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum period of 3 days, including any shipping costs.
5. As foreseen by the art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may suspend the refund until receipt of the goods or until the buyer demonstrates that he has returned the goods.
6. The site will carry out the refund by bank transfer, and if the buyer intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary for the refund to be made.
Art. 13 – Data processing
1. The buyer's data are processed in compliance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to art. 13 EU Regulation 2016/679 (Privacy Policy).
Art. 14 – Safeguard clause
1. In the event that one of the clauses of these General Conditions of Sale is void for any reason, this will in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

Art. 16 – Applicable law and competent court
1. These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the purchaser. Consequently, the interpretation, execution and termination of the General Conditions of Sale are subject exclusively to Italian law.
2. Any disputes inherent and/or consequent to the same must be resolved exclusively by the Italian jurisdictional authority. In particular, if the buyer qualifies as a consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to the applicable law (Turin).
La Peracca reserves the right to modify the site, the policies and these General Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. The buyer will be subject to the policies and terms of the General Conditions of Sale in force from time to time when ordering products from La Peracca, unless any changes to these policies and terms are required by applicable law or by the competent authorities (in which case, they will also apply to orders that the Customer has previously placed). If any provision of these General Terms and Conditions of Sale is deemed invalid, void or for any reason unenforceable, this condition will not affect the validity and efficacy of the other provisions.
Any changes and/or additions will be effective from the date of publication of the same on the website www.laperacca.com
